FDA explores requiring drug price disclosures in commercials

15 May 2018 - Drug companies on Tuesday claimed the Trump administration may not have the legal authority to make them disclose their products' prices in consumer advertising. 

Both President Donald Trump and HHS Secretary Alex Azar have cited the policy proposal as a key strategy to rein in drug prices. The U.S. Constitution's free speech protections raise legal questions about whether the FDA can compel drug makers to disclose prices in ads, said Lori Reilly, an executive vice president of the Pharmaceutical Research and Manufacturers of America, said at a health reform panel Tuesday.

FDA Commissioner Scott Gottlieb said at the event that his agency has formed a working group to delve into the legal issues and determine how to best implement the policy.
